Critical theory, as developed by Max Horkheimer during the 1930s, is not a selfsufficient academic philosophy remote from life, but is connected with individual, everyday experiences and an interest in the abolition of social injustice. Consequently, its tenets cannot be dissociated either from the substance of those experiences, or from the tissue of their derivation. Their truth remains bound to constellations of social reality. Bearing this in mind, we may distinguish “Critical Theory” from two opposite forms of philosophical and scientific (...) self‐understanding. One of these regards itself as independent of such constellations. The other acknowledges them, but reduces this understanding to a general perception of correspondences between mind and matter. In contrast, Critical Theory traces the dependence of consciousness on social existence with the aim of abolishing that dependence. It thus, on the one hand, represents critical unrest vis‐à‐vis all putative first and last certainties, vis‐à‐vis metaphysics and ontology, vis‐à‐vis all thinking that has forgotten its own contingency. On the other hand, it retains the emphatic concept of truth of its philosophical tradition, and thus avoids disintegrating into an indecisive relativism in which everything would be equally true or equally false. This paper defends the possibility of dirty hands against the longstanding skepticism that an action cannot be simultaneously right and wrong and that dirty hands cases are therefore impossible. While skeptics are right to recognize that prima facie reasons against violating moral duties may be overridden, they are wrong to deny that actions required by necessity may nevertheless remain wrong. Dirty hands cases capture the simultaneous necessity of disregarding moral duties in certain circumstances and the reprehensibility of wronging people even (...) in cases in which this is all-things-considered permissible. Rather than indicating any deficiency in our moral reasoning, the capacity to accommodate the possibility of dirty hands, along with the reality of moral conflict, is a strength of a moral theory. This paper examines whether the prospect of compensation may render otherwise disproportionate harms proportionate. It argues that we should reject this possibility. Instead, it distinguishes duties of compensation as a requirement of rectificatory justice from a harm’s degree of compensability, and argues that only the latter is relevant to proportionality. On this view, failing to compensate constitutes a distinct wrong, while harms that are not adequately compensable carry extra weight in proportionality calculations. This explains how the prospect of compensation affects (...) permissions to harm, without relying on the dubious assumption that disproportionate harms may be rendered proportionate by future compensation. This paper challenges one line of argument which has been advanced to justify imposing risks of collateral harm on prospective beneficiaries of armed humanitarian interventions. This argument - the ‘Beneficiary Principle’ - holds that non-liable individuals’ immunity to being harmed as a side effect of just armed humanitarian interventions may be diminished by their prospects of benefiting from the intervention. Against this, I defend the view that beneficiary status does not morally distinguish beneficiaries from other non-liable individuals in such a (...) way as to permit exposing them to greater risks of being harmed. The argument proceeds in four steps. I first show that the BP can neither be grounded in liability-based nor in lesser-evil justifications for harming. I then argue that a standalone justification for unintended harming based on beneficiary status would face at least two critical challenges. The first concerns the BP’s applicability to collectives; the second questions the normative weight we can plausibly ascribe to beneficiary status when beneficiaries are such by virtue of being victims of wrongful threats of harm. I argue that standing to benefit is morally irrelevant when the benefit consists in the mitigation or prevention of wrongful harms, and consequently suggest that the BP may only serve as a distributive principle in allocating risks of harm if it is disambiguated in a number of critical aspects and applied in a more narrowlydefined set of circumstances. Katherine Eggert explores the crumbling state of humanistic learning in the sixteenth and seventeenth centuries and the benefits of relying on alchemy despite its recognized flaws.

Up until the present day, Confucianism has been a major factor in the normative discourses of East Asia. At first glance, it has sided with the preservation of the old and against innovation, according to Confucius’s self-declaration that he “only transmits and creates nothing new.” This also describes the historical role that Confucianism in distinction to other philosophies has actually played over long stretches of time. Nevertheless, Confucian ethics contains structural features, figures of thought and ideas which point beyond mere (...) traditionalism. They reflect the deep crisis of tradition against the background of which Confucianism came into existence and which has left its mark on it. They could set free a dynamic that made it possible to distance oneself from the Confucian tradition within this tradition itself and open it up to something new, if not in terms of its creation then at least in terms of its acceptance and support. This potential also intrinsically relates to the possibility of a “modern” Confucianism. The following three short essays do not claim to give a comprehensive account of the outlined problematique. It is only intended to throw a light upon some of the corresponding thought formations that developed in ancient China and explore by a few examples the extent to which the said potential has actually been realized in later Confucian discourse in Korea and Japan, assuming that border crossing might be among the factors to unleash it. This paper examines the necessity requirement in cases in which more than one defensive agent could avert the same threat of harm. It argues that the most compelling view of necessity is one that seeks to minimize harms by extending the constraint across agents pursuing the same defensive aim. Whether it is necessary, and to that extent permissible, for one agent to use defensive force may depend on whether another agent is likely to avert the same threat in a less (...) harmful manner. This conception of necessity, however, seeks only to minimize harms in pursuit of a specific aim; it does not tell us which one of several ends to pursue based on how harmful different acts of rescue would be. This throws new light on the ethics of using defensive force in situations in which agents do not act alone. (shrink)

This paper illuminates a typically obscured ground for rectificatory obligations: harms justified as ‘lesser evils.’ Lesser-evil harms are not the result of overall morally prohibited acts but of acts permissibly carried out to prevent significantly greater harm. The paper argues that harms caused as unintended side effects of acting on lesser-evil justifications, notably in military rescue operations, may give rise to claims to compensation, even if (1) the military acts that caused the harms in question were justified on lesser-evil grounds (...) and (2) the victims in question are no worse off as a result; they may even owe their survival to the act of rescue. The paper defends three claims. First, being better off as a result of a harmful rescue than one would otherwise have been does not preclude claims to be compensated for harms suffered as a side effect. Second, identifying the relevant counterfactual for purposes of compensatory justice is sometimes a prescriptive, rather than a descriptive, matter. Rather than relying on empirical speculations about what _would_ have happened had a harm not occurred, we must, in certain cases, consider what agents _ought_ to have done. Finally, duties of compensation need not fall on those who caused the to-be-compensated harms. That infringing rights is permissible in certain cases does not imply that no compensation is owed, but merely that it is not necessarily rights-infringers on whom duties of compensation fall. This paper sketches elements of a theory of the ethics of autonomised harming: the phenomenon of delegating decisions about whether and whom to harm to artificial intelligence (AI) in self-driving cars and autonomous weapon systems. First, the paper elucidates the challenge of integrating non-human, artificial agents, which lack rights and duties, into our moral framework which relies on precisely these notions to determine the permissibility of harming. Second, the paper examines how potential differences between human agents and non-human, artificial agents (...) might bear on the permissibility of delegating life-and death decisions to AI systems. Third, and finally, the paper explores a series of resulting complexities. These include the challenge of weighing autonomous systems’ promise to reduce harm against the intrinsic value of rectificatory justice as well as the peculiar possibility that delegating harmful acts to AI might render ordinarily impermissible acts permissible. By illuminating what happens when we extend normative theory beyond its traditional boundaries, this discussion offers a starting point for assessing the moral permissibility of delegating consequential decisions to non-human, artificial agents. Recent debates about supererogatory rescues have sought to explain how it can be wrong to perform a suboptimal rescue although it would be permissible not to rescue at all. This paper proposes a new solution to this puzzle. It argues that existing accounts have neglected two critical considerations. First, contrary to what is commonly assumed, a rescue’s supererogatory nature has no bearing on the duties that apply to agents who rescue in supererogatory fashion. Second, we cannot justify harms caused as (...) a side effect of supererogatory rescues by appealing to the fact that it would have been permissible not to rescue at all. Ultimately, the paper proposes, the same duties that apply in cases in which rescuing is required also apply in cases in which rescuing is supererogatory. A rescue’s supererogatory nature, it turns out, is not the game changer we thought it was. (shrink)

This paper examines what prevents us from legally enforcing the moral imperative of protecting human rights during military operations carried out for distinctly humanitarian purposes. The answer, I argue, lies not in familiar objections to bringing the law into greater congruence with morality, but in international law's indeterminacy regarding the use of force. Preserving stability within the nascent international legal system comes at the cost of a law that eschews the protection of individual rights even in cases in which the (...) protection of human rights is what justifies military action. The tension between state sovereignty and the protection of human rights thus not only generates well-known controversies about the lawfulness of military intervention. It also prevents us from devising laws to protect human rights during wars whose very purpose it is to stop human rights violations. Protecting human rights during humanitarian interventions may thus remain an undertaking as quixotic as it is morally urgent. (shrink)

This paper defends revisionism against a challenge: that it cannot convincingly hold that many instances of killing in war are morally wrong but should nonetheless remain legally permissible. The paper argues that we should view the relationship between the morality of war and the laws of war as analogous to the relationship between fundamental principles and rules of regulation in debates about theories of justice. This yields a fresh justification for the law’s divergence from morality, which absolves revisionism from the (...) twofold charge of being at once irrelevant and incoherent. It also helps clarify persisting ambiguities concerning the contrast between war and ‘ordinary life,’ the contested notion of a ‘deep morality’ of war, and revisionism’s relationship to ideal and non-ideal theory. We examine two competing solutions to Benardete paradoxes: causal finitism, according to which nothing can have infinitely many causes, and the unsatisfiable pair diagnosis (UPD), according to which such paradoxes are logically impossible and no metaphysical thesis need be adopted to avoid them. We argue that the UPD enjoys notable theoretical advantages over causal finitism. Causal finitists, however, have levelled two main objections to the UPD. First, they urge that the UPD requires positing a ‘mysterious force’ that prevents paradoxes from (...) arising. Since such a force is implausible, the UPD is in trouble. Second, they employ recombination or patchwork principles to argue that paradoxical situations would be possible if causal finitism were false. Since such situations are not possible, causal finitism is true, and so a substantive metaphysical thesis is needed to avoid the paradoxes. We argue that the UPD proponent can successfully respond to these objections. (shrink)

The French medical context is characterized by institutionalization of the ethical reflection in health care facilities and an important disparity between spaces of ethical reflection. In theory, the healthcare professional may mobilise an arsenal of resources to help him in his ethical reflection. But what happens in practice? We conducted semi-structured interviews with 22 health-care professionals who did and did not have recourse to clinical ethical committees. We also implemented two focus groups with 18 professionals involved in various spaces of (...) ethical reflection in order to let them debate about a better way to organize ethical reflection in their institutional contexts. The qualitative analysis allows to us to underline the coexistence of different conceptions of ethics among health care professionals. We also observed that the participants in our study shared the experience of ethically problematic situations as roadblocks in the process of communication and decision-making. We therefore report the factors which favour or inhibit the ethical course leading to the resolution or at the very least soothing of the situation at hand. Finally, we discuss methodological issues and underline the fact that while the patient is at the heart of the professional’s ethical preoccupations, this does not imply that they are actors in decisions that concern them. It has been claimed in the literature that collective intentionality and group attitudes presuppose some “sense of ‘us’” among the participants (other labels sometimes used are “sense of community,” “communal awareness,” “shared point of view,” or “we-perspective”). While this seems plausible enough on an intuitive level, little attention has been paid so far to the question of what the nature and role of this mysterious “sense of ‘us’” might be. This paper states (and argues for) the following five claims: (1) (...) it is neither the case that the sense in question has the community (or “us”) in its content or as its object nor does the attitude in question presuppose a preexistent community (or “us”) as its subject. (2) The “sense of ‘us’” is plural pre-reflective self-awareness. (3) Plural pre-reflective self-awareness plays the same role in the constitution of a common mind that singular pre-reflective self-awareness plays in the individual mind. (4) The most important conceptions of plural subjects, collective persons, or group agents in the current literature fail to recognize the nature and role of plural self-awareness, and therefore fall short in important respects. (5) In spite of the striking similarities between the plural and the singular mind, there are important differences to consider. The authority of the singular first person point of view has no equivalent in the plural case. (shrink)

We argue that there is a conflict among classical theism's commitments to divine simplicity, divine creative freedom, and omniscience. We start by defining key terms for the debate related to classical theism. Then we articulate a new argument, the Aloneness Argument, aiming to establish a conflict among these attributes. In broad outline, the argument proceeds as follows. Under classical theism, it's possible that God exists without anything apart from Him. Any knowledge God has in such a world would be wholly (...) intrinsic. But there are contingent truths in every world, including the world in which God exists alone. So, it's possible that God contingently has wholly intrinsic knowledge. But whatever is contingent and wholly intrinsic is an accident. So, God possibly has an accident. This is incompatible with classical theism. Finally, we consider and rebut several objections. (shrink)

Benardete paradoxes involve a beginningless set each member of which satisfies some predicate just in case no earlier member satisfies it. Such paradoxes have been wielded on behalf of arguments for the impossibility of an infinite past. These arguments often deploy patchwork principles in support of their key linking premise. Here I argue that patchwork principles fail to justify this key premise.

Modal collapse arguments are all the rage in certain philosophical circles as of late. The arguments purport to show that classical theism entails the absurdly fatalistic conclusion that everything exists necessarily. My first aim in this paper is bold: to put an end to action-based modal collapse arguments against classical theism. To accomplish this, I first articulate the ‘Simple Modal Collapse Argument’ and then characterize and defend Tomaszewski’s criticism thereof. Second, I critically examine Mullins’ new modal collapse argument formulated in (...) response to the aforementioned criticism. I argue that Mullins’ new argument does not succeed. Third, I critically examine a powers-based modal collapse argument against classical theism that has received much less attention in the literature. Fourth, I show why God’s being purely actual, as well God’s being identical to each of God’s acts, simply cannot entail modal collapse given indeterministic causation. This, I take it, signals the death of modal collapse arguments. But not all hope is lost for proponents of modal collapse arguments—for the death is a fruitful one insofar as it paves the way for new inquiry into at least two new potential problems for classical theism. We draw out significant consequences of a relatively popular theory of metaphysical modality—branching actualism—for cosmological arguments for God’s existence. According to branching actualism, every possible world shares an initial history with the actual world and diverges only because causal powers (or dispositions, or some such) are differentially exercised. We argue that branching actualism undergirds successful responses to two recent cosmological arguments: the Grim Reaper Kalam argument and a modal argument from contingency. We also argue that branching actualism affords a response (...) to one popular defense of the classic contingency argument. What results are new difficulties for several cosmological arguments arising from the metaphysics of modality. (shrink)

James Henry Collin recently developed a new symmetry breaker favouring the ontological argument’s possibility premiss over that of the reverse ontological argument. The symmetry breaker amounts to an undercutting defeater for the reverse possibility premiss based on Kripkean cases of a posteriori necessity. I argue, however, that symmetry re-arises in two forms. First, I challenge the purported asymmetry in epistemic entitlements to the original and reverse possibility premisses. Second, relevantly similar Kripkean cases equally undercut the original possibility premiss.

This book critically assesses arguments for the existence of the God of classical theism, develops an innovative account of objects’ persistence, and defends new arguments against classical theism. The authors engage the following classical theistic proofs: Aquinas’s First Way, Aquinas’s De Ente argument, and Feser’s Aristotelian, Neo-Platonic, Augustinian, Thomistic, and Rationalist proofs. The authors also provide the first systematic treatment of the ‘existential inertia thesis’. The modal ontological argument (MOA) proceeds from God’s possible existence to God’s actual existence. A prominent objection to the MOA is that it suffers from a symmetry problem: an exactly parallel modal ontological argument can be given for God's non-existence. Several attempts have been made to break the symmetry between the arguments. Edward Feser defends the ‘Aristotelian proof’ for the existence of God, which reasons that the only adequate explanation of the existence of change is in terms of an unchangeable, purely actual being. His argument, however, relies on the falsity of the Existential Inertia Thesis, according to which concrete objects tend to persist in existence without requiring an existential sustaining cause. In this article, I first characterize the dialectical context of Feser’s Aristotelian proof, paying special attention to EIT and its rival (...) thesis—the Existential Expiration Thesis. Next, I provide a more precise characterization of EIT, after which I outline two metaphysical accounts of existential inertia. I then develop new lines of reasoning in favor of EIT that appeal to the theoretical virtues of explanatory power and simplicity. Finally, I address the predominant criticisms of EIT in the literature. (shrink)

This paper examines and compares the ways in which intentions of the singular kind and the plural kind are subjective. Are intentions of the plural kind ours in the same way intentions of the singular kind are mine? Starting with the singular case, it is argued that “I intend” is subjective in virtue of self-knowledge. Self-knowledge is special in that it is self-identifying, self-validating, self-committing, and self-authorizing. Moving to the plural form, it is argued that in spite of apparent differences, (...) attitudes of the form “we intend” are subjective in the same way. The self-knowledge at work here is plural rather than singular. This supports a plural subject account of collective intentionality. It is argued that the worries sometimes raised in the literature against the metaphysical “spookiness” of plural subjects are due to a fundamental misconception of the way in which attitudes of either kind –singular and plural – are subjective. Edward Feser defends the ‘Neo-Platonic proof ’ for the existence of the God of classical theism. After articulating the argument and a number of preliminaries, I first argue that premise three of Feser’s argument—the causal principle that every composite object requires a sustaining efficient cause to combine its parts—is both unjustified and dialectically ill-situated. I then argue that the Neo-Platonic proof fails to deliver the mindedness of the absolutely simple being and instead militates against its mindedness. Finally, I uncover two (...) tensions between Trinitarianism and the Neo-Platonic proof. (shrink)

In this paper, I distinguish three claims, which I label individual intentional autonomy, individual intentional autarky, and intentional individualism. The autonomy claim is that under normal circumstances, each individual's behavior has to be interpreted as his or her own action. The autarky claim is that the intentional interpretation of an individual's behavior has to bottom out in that individual's own volitions, or pro-attitudes. The individualism claim is weaker, arguing that any interpretation of an individual's behavior has to be given in (...) terms of individual intentional states. I argue that individual intentional autonomy implies neither individual intentional autarky, nor intentional individualism, with which it is usually lumped together. I further argue that this insight is the key to an adequate view of an important class of actions, i.e., plural actions. (shrink)

The concept of grace has for better or worse disappeared from our daily experience and aesthetic as well as educational vocabulary. This paper presents briefly Friedrich Schiller’s analysis in Über Anmut und Würde of grace as an expression of an internal morality, i.e. the notion of a beautiful soul found in classical bourgeois Bildung. We then turn to Heinrich von Kleist’s Über das Marionettentheater, which challenges Schiller’s humanism by a provocative presentation of grace as mechanical perfection. The second part of (...) the paper examines the bearing and actuality of Kleist’s text from examples pertaining to athletics/sports, drawing critically on Simon Chritchly’s What We Think about When We Think about Football. The aim is a consideration of where and how grace manifests itself and seems to be something inexplicable and ‘extra’, a gift of the gods or of nature, as it still exists even if it is not easily put into words. I anden del diskuteres Rousseaus ’platonisme’ i mere overordnet filosofisk sammenhæng, og der argumenteres for, at Rousseaus utraditionelle, pædagogisk-filosofiske Platon-læsning dels kan ses at fremdrage underbelyste centrale tematikker i Platons filosofi, dels (...) understreger deres stadige aktualitet. This study examined whether supermarkets can be considered patches in the marginal value theorem (MVT) sense despite their particular features and whether they are models of human food foraging in resource-dense conditions. On the basis of the MVT, the quantitative relationship between gains in the Euro and patch residence time was modeled as an exponential growth function toward an upper asymptote, allowing the choice of an optimal strategy under diminishing returns. N = 61 participants were interviewed about their current shopping (...) trip and contextual variables at a German supermarket and provided data to estimate relevant model parameters. A nonlinear model of the patch residence time and resulting gain based on an exponential function was fitted via nonlinear orthogonal distance regression. The results generally revealed the relationships predicted by the model, with some uncertainty regarding the estimation of the upper asymptote due to a lack of data from participants with long residence times. Despite this limitation, the data support the applicability of the MVT-based model. The results show that approaches from optimal foraging theory, such as the MVT, can be used successfully to model human shopping behavior even when participants’ verbal reports are used. (shrink)
